San Pablo, California – On Wednesday, December 15, 2021, San Pablo Police received a 9-1-1 call from an employee at the 1300 block of Market Avenue reporting a man in the parking lot carrying what appeared to be a gun of fire. At one point, the official described the man taking the magazine out of the gun and putting it back. The employee expressed fear that the man would enter the business. The official warned that the man recklessly drove his vehicle out of the parking lot.

Several San Pablo police officers responded to the scene and located the man’s vehicle traveling west on Market Avenue outside San Pablo city limits and initiated a high-risk traffic stop. The man stopped on the side of the road and the officers tried to communicate with him. During this exchange, officers noticed that the man had blood on his hands. He was instructed to get out of the vehicle and raise his hands.

After a brief exchange of words, the man got out of the car holding a firearm in his right hand and faced the officers. It was later learned that the man was in possession of a lead BB gun that closely resembled the appearance of a real gun. The officers repeated orders for the man to raise his hands while mimicking the motion of loading a firearm as if ready to fire. The man then pulled the gun to his chest and turned to the officers. Four San Pablo police officers unloaded their service weapons hitting the man. Officers immediately began providing medical assistance until paramedics arrived. Unfortunately, he was pronounced dead on the way to the hospital.

It is still unclear why the man was in the store parking lot wielding the pellet pistol or why he exited the vehicle holding the gun and mimicking the actions of a real firearm in the presence of police officers. During the investigation, detectives discovered that the man made statements to a witness of his intention to force officers to kill him. It was also discovered that the man made “goodbye” statements to family members earlier in the day.

While at the scene at the start of the incident, investigators believed the gun was an airsoft gun that usually fires plastic projectiles. In accordance with Assembly Bill 1506, the California Department of Justice was called to the scene to take over the investigation. After all the evidence was collected and analyzed by the Contra Costa County Crime Lab, it was determined that the weapon was in fact a lead BB pistol capable of firing either metal or lead BBs. The California DOJ identifies an unloaded or inoperative BB pellet gun as a deadly weapon.
