Woman Brain Dead After Being Shot by Suspect During Police Confrontation in Austin

AUSTIN, Texas – A woman was declared brain dead after being shot in the head by a man who was simultaneously firing at a police officer during a chaotic confrontation early Wednesday morning in Zilker Park. The incident, which began with the investigation of an abandoned car, triggered a massive three-hour manhunt through a residential neighborhood and ended with the suspect’s arrest after he was shot by an armed homeowner.

The female victim has been identified as 31-year-old Kay Smith. The alleged shooter, 30-year-old Brandon Thompson, now faces charges of capital attempted murder of a peace officer and burglary of a habitation. Court documents indicate the two were in a relationship and had been listed as homeless.

The series of events began around 00:3:31 a.m. when two Austin Police officers located an abandoned vehicle within Zilker Park. A check of the license plate revealed it belonged to a different car that had been reported stolen, prompting the officers to begin the process of impounding the vehicle.

Approximately thirty minutes later, around 4 a.m., Senior Officer Adam Reinhart observed a man and a woman emerging from a wooded area near the parked car. Officer Reinhart made contact with the pair as they walked away, following them on a nearby trail.

According to police accounts, the officer informed the man and woman they were being detained after they acknowledged the abandoned vehicle was theirs. At that point, the woman began walking toward the officer, while the man hesitated.

The situation escalated in an instant. Officer Reinhart gave a command for the man to remove his hand from his pocket. Instead of complying, the suspect drew a firearm and opened fire, discharging multiple rounds toward Reinhart.

One of those bullets struck Kay Smith in the back of the head. Officer Reinhart was also hit, sustaining a gunshot wound to the abdomen.

The suspect, later identified as Thompson, immediately fled the scene on foot. This initiated an extensive search operation that involved a significant police presence and lasted for approximately three hours, locking down portions of the surrounding Barton Hills area.

The manhunt concluded when Thompson allegedly broke into a nearby home. An armed resident inside the home confronted the intruder and fired shots, striking him. Thompson was subsequently taken into custody and transported to a local hospital for treatment, where he remained under police guard.

During the active search, local public safety agencies activated the Warn Central Texas alert system, sending an emergency message to approximately 100,000 phone numbers within a 2.2-mile radius, warning residents of the dangerous situation and advising them to shelter in place.

Kay Smith was rushed to Dell Seton Medical Center in critical condition. However, her injuries were so severe that a nurse at the hospital declared her brain dead on Wednesday afternoon, stating the wounds were “not compatible with life.”

This tragic medical outcome has a direct impact on the legal proceedings. While Thompson has been charged with the attempted murder of the police officer, he cannot be formally charged in connection with Smith’s death until she is officially declared deceased. As long as she remains on life support, a potential homicide charge is on hold.

Thompson’s total bond has been set at $600,000—$500,000 for the capital attempted murder charge and an additional $100,000 for the burglary charge.
