Police said the dead man had robbed a business in central São Mateus shortly before the shooting. Military police said they were initially called to the Boa Vista neighborhood after reports of gunfire. Officers found the man already dead. Investigators then reviewed surveillance images and witness accounts and linked him to the robbery that had occurred moments earlier in the city center.
The shop owner told police that he went after the man after the robbery. He also said that, once they were in the street, the man tried to take the firearm from his hand and that he fired in response. That part of his account became a central point in the case because the witness video of the shooting does not show a struggle over the gun. Instead, the recorded portion shows the shooter approaching and firing directly at the man.
Authorities reported that the victim was struck by about seven gunshots. A later account based on the police occurrence record said forensic examination at the scene found gunshot wounds in several areas of his body, including the face and neck. He was dead when police reached the location.
The shop owner remained at the center of the police response after the shooting. The occurrence record described him as cooperative when officers transported him to the Regional Police Station in São Mateus. Police seized the firearm used in the shooting, identified in the record as a Taurus PT 938 .380-caliber pistol registered in Brazil's National Weapons System, along with 32 intact rounds of ammunition. The weapon was taken for forensic examination.
The fact that the pistol was registered did not end the legal inquiry into how it was used. Police records described the owner as having legal possession of the firearm, while the fatal shots were fired outside the store after he had pursued the man into the street.
Civil Police formally booked the shop owner for homicide following the arrest and sent him to the São Mateus Provisional Detention Center. That initial detention was followed by a custody hearing on May 17.
State prosecutors later confirmed that a judge converted the arrest into preventive detention. The court found that continued custody was warranted while the homicide case proceeded. In the decision, the judge focused on the allegation that the shop owner pursued the victim after the property crime had already ended and then fired in a public area. The court considered the circumstances serious enough to present a concrete risk to public order and found less restrictive measures insufficient at that stage.
The preventive detention order also addressed the shop owner's self-defense argument. The judge did not accept that claim as established during the custody hearing. Instead, the ruling said the defense required a fuller examination of evidence during the criminal proceedings, including the circumstances of the pursuit and the shooting.
Police said the dead man had recently left the prison system and had prior records involving robbery, drug trafficking and homicide. Those records were separate from the question of whether the shop owner's use of deadly force after the robbery was legally justified.
There are differences in published accounts about some details of the incident. The shop owner's statement described an attempt by the other man to take the gun, while the available video of the fatal encounter does not show that action. Some early accounts also characterized the preceding offense differently, but police statements and surveillance review described it as a robbery in which money, personal belongings and store items were taken.
The direct visual evidence is clearest about the killing itself. The recording shows the shop owner confronting the man in the street and firing multiple rounds at close range, including shots after the man falls. The earlier store robbery is not shown in that street video and is established through police findings, surveillance footage from the commercial area and witness information.
The body was transferred to the Regional Legal Medicine Section in Linhares for an autopsy before release to relatives. The firearm and ammunition were seized as evidence.
The latest concrete judicial development located in the case was the conversion of the shop owner's arrest into preventive detention following the May 17 custody hearing. That ruling was a pretrial custody decision, not a final finding of guilt. It left the homicide case to proceed with the self-defense claim and the recorded shooting to be examined against the remaining evidence.
